We strongly object to the allegations of the MP from BSP for Bulgaria, Mr. Blagovest Kirilov, concerning Information Services, set out in a post on Facebook on 14.06.2022, available at https://m.facebook.com/326636544072504/posts/5026144407455004/, that "the model of operation of Information Services is essentially a compulsory "in-house" contracting with a complete lack of control by the state and by its deliberate decision.“
On the basis of §45, paragraph 1 of the Transitional and Final Provisions of the Act on Amendments and Supplements to the Electronic Governance Act (EGA) (The Gazette No 94 of 2019, effective as of 29.11.2019, supplemented – The Gazette No 102 of 2019, effective as of 29.11.2019), defining the powers of Information Services as a national system integrator in contracting the activities under article 7c of the EGA and in conjunction with § 45, paragraph 2 of the Transitional and Final Provisions to the same Act, the company concludes contracts for system integration with the administrations defined by Decision No 727 of the Council of Ministers of 2019, as subsequently amended and supplemented. In this case, the exception under article 14, paragraph 1, item 5 of the Public Procurement Act (PPA) - the so-called "in-house" award - is not applicable and the system integration contracts are not concluded on this basis. When concluding contracts for system integration, the administrations and Information Services strictly comply with the PPA, the EGA, their implementing regulations, as well as with the Guidelines for unification of the practice of definition and implementation of the system integration activities under article 7c of the EGA, approved by Decision No 481 of the Council of Ministers of 14 July 2020. As of 15.06.2022 the scope of the system integration under article 7c of the EGA includes 19 administrative authorities, which account for about 3% of the total number of administrative authorities in the Republic of Bulgaria. Taking into account the above circumstances, we strongly object to Mr Kirilov's assertion that "centralized and complete control over the cash flows in the IT market has been achieved" by Information Services.
In the course of performance of its functions as a system integrator under article 7c of the Electronic Governance Act (EGA), when contracting system integration works to third parties, Information Services acts as a public contracting authority under the Public Procurement Act in strict compliance with the applicable laws. All procurement documents announced by the company are publicly available in the information system CAIS EOP managed by the Public Procurement Agency, at: https://app.eop.bg/today (for the procurement announced after 13.06.2020) and on the Buyer's Profile on the official website of the company and in the Public Procurement Register at https://www.aop.bg/ (for the procurement announced up to and including 13.06.2020). The technical specifications for the procurement are drafted following a detailed analysis of the needs and requirements requested by the administrations included in the scope of the system integration, in order to maximise the effectiveness and efficiency of budget spending and to achieve stability and security in the implementation of the legal business processes in the administrations. When drafting technical specifications and setting procurement budgets, it is mandatory that the current product lists of at least three leading global manufacturers are examined in order to avoid requirements that could be seen as restrictive and to achieve levels of discounts that are unattainable in procurements carried out individually by the administrative authorities. In addition to the examination, the company sends the technical specifications to the global manufacturers represented in Bulgaria in order to avoid overt or covert opportunities to restrict competition and obtain budget prices. Key at this point is the company’s direct communication with the global manufacturers, not their sales representatives. These examinations ensure full transparency and equal market opportunities for all potential participants, whether they are registered in Bulgaria or abroad.
Out of the 327 public procurement contracts announced by the company so far, 99% have been awarded on the basis of the "lowest" price criterion, with the only requirement for the bidders being that they are authorised by the manufacturer of the relevant hardware and/or standard software. With regard to the subject matter of the procurement, for the supply of hardware it is a mandatory requirement that the products supplied are new, unused, in the manufacturer's current production list and compliant with the Bulgarian standards for degree of protection and electromagnetic compatibility. As a result of this approach to the procurement of hardware and standard software in 2021, we have achieved the provision of optimal computer configurations in the administration at best uniform prices for all, with a saving of BGN 8.7 million for the administrative bodies (compared to the budgeted expenditure for the same equipment), and a saving of over BGN 1.9 million (45% of the estimated cost) for 2,200 workstations for one administrative body alone.
The allegation of a "complete lack of control" over the work of Information Services is not true. As a commercial company, Information Services is subject to control by all state control authorities (NRA, NSSI, General Labour Inspectorate), as a public enterprise - to control under the Public Companies Act and its implementing regulations, under the Public Sector Internal Audit Act, under the Public Sector Financial Management and Control Act, under the State Financial Inspection Act and under the Court of Auditors Act, and as a contracting authority under the Public Procurement Act - also by the Public Procurement Agency (the latest Statement on control under article 232 of the Public Procurement Act was issued by the Public Procurement Agency (PPA) under IN 20220510-5948-0021 and concerns draft documents for a public procurement for the supply of equipment, and the opinion is free of any reservations). Last but not least, the decisions on the public procurements announced by the company are subject to appeal before the Commission on Protection of Competition (CPC) under the Public Procurement Act.
So far, out of the more than 650 decisions issued on open public procurements, 2 have been appealed, in both cases the proceedings before the CPC have been terminated (in one case - due to termination of the procedure following an internal error, and in the other - due to withdrawal of the appeal). There have been no alerts received regarding the public procurements announced by us and the decisions adopted in relation thereto.
Our actions as the contracting authority for the public procurement with identification number 05948-2022-0005 commented by Mr. Kirilov (including the decisions to open, to amend, to terminate the procedure for Lot 4 and to select a contractor for each of the other lots) have not been appealed under the PPA and have become effective. The public procurement was launched on 28.01.2022, the decision to approve the amendment was published on 16.02.2022 and the decisions to appoint the contractor under lots 1, 2, 3, 5 and 6 and to terminate the procedure under lot 4 were published on 25.03.2022 and entered into effect on 05.04.2022, after which procurement contracts were concluded under lots 1, 2, 3, 5 and 6 and are in the process of being executed. It is puzzling to note the interest shown in this open procurement procedure almost five months after its launching and two months after the conclusion of the procurement contracts, as well as Mr Kirilov's allegations of defects in the technical specifications.
With regard to the allegations that the technical specifications were drafted according to "vague criteria", we bring to your attention comparative tables concerning the requirements contained in the Technical Specifications for lots 2 and 3, from which it is clear that the laptop computer configurations offered by three global manufacturers comply with our requirements.

The bids were opened in reverse order - the price proposals were opened and examined first, bids were received from five companies, with the proposed prices in the range of BGN 149, which confirms the existence of strong competition between the participants. The ranking was carried out according to the 'lowest' price award criterion for all the lots, with the tenderers offering the lowest price being ranked first. With regard to the unit prices of the equipment achieved under the procurement, it should be noted that they are more than 15% lower than the lowest prices achieved under the procurement contracts announced by the Central Procurement Unit of the Ministry of Finance. The two procurements were carried out at the same time. The bidders as both manufacturer and bidder almost 100% match. A comparison with the prices achieved in a public procurement announced by the Ministry of Finance (at https://app.eop.bg/today/171908) shows that the highest price in the above-mentioned tender of Information Services is almost 5% lower than the lowest price in the public procurement of the Ministry of Finance.
The unit prices achieved in the public procurement with identification number 05948-2022-0005 and the contracts concluded enable us to offer to the administrations quality and reliable equipment at the lowest possible price, which will provide to the civil servants the longest possible period of use with warranty support, as well as opportunities to provide post-warranty support after the expiry of warranty period. In the second quarter, the Ministry of Interior entered into a contract with Information Services following an analysis of proposals from the Ministry's specialised directorate and the company's proposal. The contract is for the supply of 5 900 computer configurations, and as a result of the low price proposed by the company, the Ministry of Interior will realise savings of BGN 2 427 600 (23% compared to the estimated price set by the specialised directorate).
